Appeals Court Sets Hearing In Estate Case

(3-9-2010) An appeals court has granted Michael Jackson's father Joe the right to contend that he should be involved in the decisions regarding his son's estate.

The Second District Court of Appeal said on September 2 , 2010 that the appeal by Joe Jackson would be heard on October 6, 2010.

Last year, Joe Jackson challenged a ruling by a state judge that the estate would be run by attorney John Branca and music executive and family friend John McClain.

John Branca and John McClain had been designated in  Michael Jackson's 2002 will to administer his estate.

The will omitted Joe Jackson — effectively denying him any stipend or decision-making authority.

"I think it's an important issue for all fathers around the country and around the world that when their child dies they should have a say-so in their child's estate," said attorney Brian Oxman, who represents Joe Jackson.

Attorney Howard Weitzman, who represents the estate, said the administrators were meeting all obligations to the beneficiaries named in the will.

"As I've said before, Mr. Jackson's appeal is not well taken," Weitzman said.

The singer's estate has earned tens of millions of dollars since Michael Jackson's passing.

Furthermore, Joe Jackson is also pursuing a federal wrongful death lawsuit against Dr. Conrad Murray, who has pleaded not guilty to involuntary manslaughter in the singer's death.

The costs of the wrongful death lawsuit should be paid by Michael Jackson's estate, Oxman said.

The estate is not a party to the lawsuit.

Gary May Miss Another Deadline In Jackson Museum

MJ(2-9-2010) Gary, Indiana, birthplace of Michael Jackson and all of his famous siblings, might miss its second deadline for turning property over to developers of a museum honoring the King of Pop his family this week.

Corporation Counsel, Susan Severtson, said Jackson Family Foundation President Simon Sahouri has been in town with his team this week and the transfer should happen "very shortly."

"The process is moving forward," Severtson said.

Gary's Board of Public Works and Safety gave its blessing three months ago to a deal in which the city promised to transfer five parcels of Glen Park property to the Jackson Family Foundation. The deal was signed by Sahouri and Jackson's parents, Katherine and Joe Jackson.

They promised to build a $300 million entertainment complex including a Michael Jackson Performing Arts Center on the site however, Michael Jackson's estate has not sanctioned those plans.

The original deadline for close of escrow on the transfer was 30 days after the deal was executed on June 2 but, the city approved a time extension in July allowing for another 60 days.

That new deadline passes this week, and county records show the land still has not changed hands. The parcels in question include Gilroy Stadium and parts of South Gleason Golf Course.

Gary has been waiting for the Jackson Family Foundation to finalize its not-for-profit status before transferring the land. Severtson said Gary might approve another time extension if the transfer doesn't happen ahead of the current deadline.

This Day In HIStory

MJ(2-9-2010) On this day, back in 1995, the King of Pop hit the top of the Billboard Hot 100 chart for the last time with the song 'You Are Not Alone.'

Throughout his long and glorious career Michael Jackson was no stranger to the Billboard Hot 100 and 'You Are Not Alone' was the third single from his double-disc CD, HIStory: Past, Present and Future, Book I. The album itself was somewhat controversial in that Jackson used it as a forum to vent his frustrations about his treatment in the media. But the fans didn't seem to mind and the songs performed very well as both 'Scream' (his duet with sister Janet) and 'Childhood' each went to number 5 on the Hot 100.

But 'You Are Not Alone' — a sweet ballad that featured a video starring Jackson and his then-wife Lisa Marie Presley - was a powerhouse that took both radio and MTV by storm. The song ousted Seal's 'Kiss From a Rose' as the top song in the country, and was replaced the following week by Coolio's 'Gangsta's Paradise.'

Five days after topping the chart Jackson gave the most amazing performance at the 1995 Video Music Awards, performing a medley of hits plus a full version of both 'Dangerous' and 'You Are Not Alone,' bringing Slash along for some six-string pyrotechnics.

MJ Estate Sued

MJ(1-9-2010) Michael Jackson's former landlord has sued the singer's Estate for property damage allegedly caused between 2008 and 2009.

Aner Iglesias, who owned the 1.7 acre compound that Jackson rented in Las Vegas, has reportedly filed a lawsuit against the Michael Jackson estate, claiming he was never compensated for the $234,000 worth of damage the singer allegedly caused while living in the home with his three children.

According to TMZ, Iglesias had already filed a creditors claim with those looking after Jackson's finances following his death but, he claims he never received the damages from administrators and has decided to file the suit with the Los Angeles County Superior Court.

Legal documents state Jackson caused damage to both the interior and exterior of the property, as well as causing problems with the internal phone and alarm system.

The Vegas home boasted a chapel, maid's quarters, four bedrooms, four-and-a-half bathrooms and an 8,500 square foot basement, which the King of Pop used as a studio and place to store his book and art collections.

Iglesias put the property on the market for $12.8 million in February.
